1.About these Terms

These Website Terms of Use govern access to and use of the Elite website, including Elite Executive Career Services, Elite Corporate Solutions and links to Smart CV Builder.

The website and services are operated by New Elite Holdings (Pty) Ltd, referred to in these Terms as “Elite”, “we”, “us” or “the Company”.

These Website Terms govern use of the website itself. Purchases and engagements are governed by the terms applicable to the specific service purchased:

• Executive Solutions Terms of Service;
• Corporate Solutions Terms of Engagement; or
• Smart CV Builder Terms of Service.

If there is any conflict between these Website Terms and the terms governing a specific paid service, the service-specific terms apply to that transaction.

2.Acceptance

By using this website, you agree to these Website Terms, our Privacy Policy, Cookie Policy and applicable data-protection notices.

A separate agreement is formed when you purchase a service, accept a proposal or complete a transaction.

The version of the relevant service terms accepted when the transaction is concluded will govern that transaction. Later amendments will not retrospectively alter an existing agreement unless agreed by the parties or required by law.

Elite operates distinct service lines.

Elite Executive Career Services

Bespoke, human-led executive career branding and positioning services.

Elite Corporate Solutions

Corporate branding, leadership positioning, tender and proposal documentation, consultant and specialist profiles, workforce transition support and website design and development.

Smart CV Builder

A self-service digital CV and career-document platform.

Each service operates differently and has its own payment, delivery, amendment and cancellation rules.

5.Prices and VAT

Prices applicable to a transaction will be displayed on the relevant product page, checkout, proposal or quotation before you commit to the purchase.

New Elite Holdings is not currently registered as a VAT vendor. VAT is therefore not charged.

If our VAT status changes in future, any change in tax treatment will apply prospectively and will be reflected in the relevant price, quotation or invoice.

6.Electronic transactions

Before placing an online order, you must be given an opportunity to review the transaction, correct mistakes and withdraw before final submission.

The applicable price, service description, payment method and service-specific terms will be made available before purchase.

Order confirmations, receipts and other transaction records may be supplied electronically. You should retain copies for your own records.

7.Permitted website use

You may use this website for lawful personal or business purposes connected to evaluating, purchasing or using our services.

You may not:

• interfere with the operation or security of the website;
• attempt unauthorised access to accounts, systems or data;
• introduce malware or harmful code;
• scrape or systematically extract protected content without permission;
• reproduce or commercialise our proprietary templates, designs, methodologies or website content without permission;
• use the website in a fraudulent, misleading or unlawful manner.

8.Intellectual property

The website, brand assets, software, layouts, templates, graphics, methodologies, written content and other proprietary material remain the intellectual property of New Elite Holdings or the relevant licensors.

Purchasing a service does not transfer ownership of our underlying templates, systems, software, methods or brand assets.

Rights to client-specific deliverables are dealt with in the relevant service-specific terms.

9.Third-party platforms and links

Our website may link to or integrate with third-party services such as payment providers, social networks, hosting providers, analytics providers and other websites.

Those services are operated independently and may have their own terms and privacy practices.

A link or integration does not imply endorsement unless expressly stated.

10.Website availability

We aim to keep our website and online services available and secure, but continuous or error-free access cannot be guaranteed.

Maintenance, hosting interruptions, telecommunications failures, security incidents or events outside our reasonable control may temporarily affect availability.

Nothing in this clause excludes rights that cannot lawfully be excluded.

Personal information is handled in accordance with our Privacy Policy, POPIA notices and applicable law.

Depending on the service and context, New Elite Holdings may act as a responsible party or as an operator processing information on behalf of a corporate client.

You remain responsible for protecting your own passwords, devices and account access.

You must notify us promptly if you reasonably believe that your account has been accessed without authority.

13.Disclaimers

Career, branding and professional-document services do not guarantee:

• employment;
• interviews;
• appointments;
• board positions;
• promotions;
• salary outcomes;
• recruiter engagement;
• tender success;
• procurement acceptance; or
• any particular commercial outcome.

Any specific guarantee expressly included in a written proposal will apply according to its wording.

14.Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising solely from use of the website itself, including losses resulting from third-party systems, telecommunications interruptions or unauthorised conduct outside our reasonable control.

Any service-related liability is governed primarily by the relevant service-specific terms.

15.Governing law

These Terms are governed by the laws of the Republic of South Africa.

Nothing in these Terms removes any mandatory consumer protection available to a person under applicable law.
