Smart CV Builder Terms of Service

1.About Smart CV Builder

Smart CV Builder is a self-service digital career-document platform operated by New Elite Holdings (Pty) Ltd.

It enables users to create, edit, improve and download career documents using automated systems and artificial intelligence.

Smart CV Builder is separate from Elite Executive Career Services.

Smart CV Builder does not include human CV writing, human editing or human revision unless an additional human service is expressly purchased.

2.Current products and prices

Smart CV Builder currently offers:

Prices may change prospectively.

The price shown and accepted at checkout is the contractual price for that transaction.

3.Currency selection

South African visitors are ordinarily shown South African rand pricing by default.

Visitors outside South Africa are ordinarily shown US dollar pricing by default.

Where the currency-switching function is available, users may choose to pay in ZAR or USD.

The ZAR prices are separate local price points. They are not represented as a live exchange-rate conversion of the USD prices.

A payment provider, card issuer or bank may apply its own foreign-exchange rate or charges where the payment method and selected currency require conversion.

4.Payment methods

Available payment methods are those displayed at checkout.

Depending on the selected currency and system availability, these may include:

• PayFast;
• PayPal;
• debit or credit card; or
• another supported payment method.

Smart CV does not store full payment-card details on its own servers where payment is handled by an external payment provider.

5.How the service works

Users may create and edit their document before payment.

This may include:

• uploading an existing CV;
• entering information manually;
• extracting information;
• editing extracted content;
• selecting a target role;
• using AI rewriting or regeneration;
• selecting a design; and
• selecting available design attributes.

Payment unlocks the paid document or download functionality associated with the selected product.

6.Editing before payment

Before payment, users may edit their working CV without an additional editing charge.

Where available, users may regenerate or rewrite content using the platform’s AI tools before purchasing.

There is no separate fee for ordinary pre-purchase editing.

7.Cover Letter purchases

A purchased Cover Letter is treated as the final paid document generated for that purchase.

The purchase does not include ongoing paid revisions to that Cover Letter.

If the user wants a materially different Cover Letter after purchase, including one for another role or employer, a new Cover Letter purchase is required.

8.CV Updates after purchase

The paid CV remains available for re-download during the applicable availability period.

A user may continue to change information in the builder where the platform permits this.

However, downloading a new amended version of an already-purchased CV requires the purchase of a CV Update.

A paid CV Update creates a new paid document version.

9.Document availability and re-downloads

Purchased documents are ordinarily retained and made available for re-download for 24 months from the date of purchase.

Where a paid CV Update is purchased, a new 24-month availability period begins for the updated paid version from the date of that update purchase.

Smart CV Builder is a document-creation service, not a permanent document-storage service.

After the applicable 24-month period:

• Smart CV does not guarantee that the document or source information will remain stored;
• continued availability, where it occurs, does not create an obligation to retain it indefinitely; and
• users should keep their own downloaded copies.

10.Account and data deletion

Users may request deletion of their personal information, subject to information that must lawfully be retained.

Where account controls permit it, users may close their account and delete stored files themselves.

Deleting an account or requesting deletion may permanently remove access to stored documents.

The user is responsible for downloading any documents they wish to keep before deletion.

11.Artificial intelligence

Smart CV Builder uses automated systems and artificial intelligence to assist with document creation and rewriting.

AI-generated content can be incomplete, inaccurate or inappropriate.

The user must check every factual statement before using or submitting a generated document.

In particular, users must verify:

• names;
• dates;
• job titles;
• employers;
• qualifications;
• achievements;
• responsibilities;
• skills;
• metrics;
• locations; and
• any other factual claim.

Smart CV Builder must not be used to intentionally fabricate or misrepresent credentials or experience.

12.User responsibility

The user is ultimately responsible for the content submitted to an employer, recruiter or other third party.

The user confirms that information supplied to Smart CV Builder is truthful and that they have authority to use any uploaded material.

13.ATS and employment outcomes

Smart CV Builder is designed with ATS compatibility in mind, but ATS systems differ.

We do not guarantee that:

• a document will pass every ATS;
• an ATS will parse every field correctly;
• a particular employer will use an ATS;
• the CV will achieve a particular score;
• the user will receive an interview; or
• the user will obtain employment.

Where a free ATS scanning or checking tool is provided, its results are indicative only.

14.Self-service nature

Smart CV Builder is a self-service product.

The purchase price does not include:

• human CV writing;
• professional rewriting by an Elite writer;
• human proofreading;
• human revisions;
• career consultation; or
• personalised executive advisory.

Users requiring a human-led service should purchase the appropriate Executive Solutions service separately.

15.Technical support

We may provide reasonable technical support for problems with:

• account access;
• payment confirmation;
• generation errors;
• download failures; or
• platform functionality.

Technical support does not include human rewriting or editing of career content unless expressly purchased.

16.Immediate digital supply and cooling-off

Smart CV documents are personalised digital services supplied electronically.

At checkout, the user may be asked to expressly request immediate supply or unlocking of the purchased document.

Where applicable law provides a cooling-off right, that right remains available unless a lawful exception applies.

Where the user expressly requests that supply begin immediately, the user acknowledges that commencement of supply may affect or end a statutory cooling-off right to the extent permitted by law.

17.Refunds

Because the product is personalised and digitally supplied, change-of-mind refunds are generally not available once the purchased document has been unlocked or supplied, subject to applicable law.

If the platform fails to supply the purchased document because of a technical defect attributable to Smart CV, we will first attempt to correct the problem within a reasonable time.

Where the paid service cannot reasonably be supplied or corrected, an appropriate refund may be provided.

Nothing in this section removes any statutory remedy that cannot lawfully be excluded.

18.Uploaded files

Files uploaded to Smart CV Builder are used for purposes connected to providing the service and are handled according to our Privacy Policy.

Uploads are not sold as personal data.

Users should not upload information they are not authorised to provide.

19.Intellectual property

Users retain rights in the personal information and original career information they provide.

After payment, users may download, edit, reproduce and use their final career documents for their own career and professional purposes.

New Elite Holdings retains ownership of:

• Smart CV software;
• templates;
• underlying design systems;
• prompts and workflows;
• platform functionality;
• proprietary methods; and
• other reusable intellectual property.

Users may not extract, resell, reproduce or commercially distribute Smart CV templates or platform systems as standalone products.

20.Accounts

Users are responsible for protecting their account credentials.

We may suspend access where there is reasonable evidence of:

• fraud;
• unlawful use;
• unauthorised access;
• deliberate platform abuse; or
• material breach of these Terms.

21.Service availability

We aim to keep Smart CV Builder operational but cannot guarantee uninterrupted access.

Maintenance, hosting failures, third-party outages, security incidents and other technical events may affect availability.

We will take reasonable steps to restore affected services.

22.Limitation of liability

Nothing in these Terms excludes liability that cannot lawfully be excluded.

To the extent permitted by law, New Elite Holdings’ aggregate liability arising directly from a Smart CV purchase will not exceed the amount paid for the transaction giving rise to the claim.

We are not responsible for career decisions or employer outcomes based on information the user failed to verify.

23.Privacy

Personal information is processed in accordance with our Privacy Policy and POPIA obligations.

The Privacy Policy explains the categories of information collected, purposes of processing, retention practices, security measures and data-subject rights.

24.Changes to Smart CV

We may improve, change or discontinue platform features, payment methods, prices or designs from time to time.

A change will not retrospectively alter the price or core contractual terms of a completed purchase.

25.Governing law

These Terms are governed by South African law.

Mandatory rights available to consumers remain unaffected.
