Executive Solutions Terms of Service

1.Scope

These Terms apply to individual Executive Solutions purchased from Elite Executive Career Services.

Executive services may include:

• Executive CV and Cover Letter;
• Executive LinkedIn Optimisation;
• Executive Biography;
• Leadership Portfolio;
• Executive Career Portfolio;
• Board CV, Board Resume or Board Pack;
• Executive Positioning Strategy;
• Executive Role Suitability Report;
• Executive Interview Preparation;
• Executive Foundation;
• Executive Advantage;
• Executive Elite;
• Board & Leadership;
• Bespoke Retained Advisory; and
• other executive services expressly described at the time of purchase.

Elite Executive Career Services is a career-branding and executive-positioning practice. We are not a recruitment agency, employment agency or headhunting firm.

2.Formation of the agreement

An Executive Solutions agreement is formed when:

1. you select and order a service;
2. you accept these Executive Solutions Terms; and
3. payment is successfully received.

We may decline or cancel an order where we reasonably cannot provide the service, where the order appears fraudulent or unlawful, or where the client requests misrepresentation.

If we cancel an accepted order before substantive work begins, amounts paid for the unperformed service will be refunded.

3.Payment

Executive Solutions are payable in full before work begins.

Payment methods may include PayPal, PayFast, card or another payment method displayed at checkout.

The price presented before checkout is the price applicable to that order.

No VAT is currently charged.

4.Intake and commencement

Executive services use a written intake process rather than a telephone consultation as the standard onboarding method.

After purchase, the client must complete the relevant questionnaire and provide the documents and information reasonably required for the service.

Work is regarded as having commenced once the completed intake information has been received and substantive preparation, research, writing, analysis or design has begun.

Incomplete or delayed information may extend delivery timelines.

5.Delivery

Unless a different timeframe is stated for the specific product, the first Executive CV draft is ordinarily delivered within two working days after receipt of a complete intake and all material required to begin.

Different products may require different delivery periods.

Delivery estimates are calculated from receipt of complete information, not merely from the date of payment.

If further information is required, the delivery period may pause until it is supplied.

6.Revisions

Where revisions are included:

• up to five revision rounds are included;
• the revision period runs for 30 calendar days from delivery of the first draft;
• feedback should be consolidated and supplied clearly;
• revisions must remain within the original agreed scope.

After the 30-day period, edits may attract an additional fee.

Material changes such as a new career direction, substantial new employment history or a different target may require a new engagement.

7.LinkedIn services

Where LinkedIn Optimisation is included, the written LinkedIn content is ordinarily prepared after the CV or core positioning has been approved, unless otherwise agreed.

We do not require or request a client’s LinkedIn password unless an expressly agreed implementation service lawfully requires account access.

LinkedIn is a third-party platform. Elite is not affiliated with, sponsored by or endorsed by LinkedIn or Microsoft.

8.Client responsibility and factual accuracy

You are responsible for ensuring that all information supplied to us is truthful, accurate and complete.

You must review drafts carefully before submitting or publishing them.

We may restructure, clarify and professionally present information, but we will not knowingly fabricate:

• employment;
• qualifications;
• professional registrations;
• achievements;
• responsibilities;
• dates;
• metrics; or
• other credentials.

We may terminate an engagement where a client asks us to misrepresent material facts.

9.Cancellation and refunds

The following commercial cancellation policy applies to change-of-mind cancellations, subject always to rights that cannot lawfully be excluded.

Before submission of the intake questionnaire

A full refund is available.

Any unavoidable non-refundable third-party payment or banking charges may be deducted where legally permissible.

After submission of the questionnaire but before delivery of the first draft

A 70% refund is available.

The retained amount compensates for onboarding, review, research, preparation and reserved professional capacity.

After delivery of the first draft

No change-of-mind refund is available.

This does not remove any statutory right you may have where a service has not been performed to the standard required by law.

Where reasonably possible, our first remedy for a service issue will be to correct the work.

10.Electronic cooling-off rights

Where South African electronic-commerce law gives you a statutory cooling-off right, that right remains available unless an applicable legal exception applies.

Where you expressly request that we begin providing a personalised service before the statutory cooling-off period expires, you acknowledge that this may affect or end the statutory cooling-off right to the extent permitted by law.

The checkout or order process may therefore include a separate request for immediate commencement.

11.Interview preparation

Executive Interview Preparation is personalised to the material and opportunity supplied by the client.

Where included, it may cover matters such as:

• mock executive or board interviews;
• leadership and achievement story development;
• role-specific preparation;
• verification readiness;
• compensation preparation; and
• interview positioning.

The service does not guarantee an offer, appointment or particular interview outcome.

12.Positioning and suitability work

Executive Positioning Strategy, Role Suitability Reports and similar advisory services represent professional analysis based on the information available at the time.

They are not recruitment decisions and do not guarantee suitability in the view of an employer, recruiter, nomination committee or board.

13.Intellectual property

After full payment, you may use your final client-specific written deliverables for your own professional career purposes without time limit.

Elite retains ownership of:

• templates;
• layouts;
• design systems;
• proprietary frameworks;
• methodologies;
• internal tools; and
• reusable intellectual property.

Templates and editable design systems are not sold unless expressly agreed.

14.Confidentiality

Client information and deliverables are treated as confidential.

We do not publicly identify clients or publish their documents without permission, except where disclosure is required by law.

15.No outcome guarantee

We do not guarantee employment, interviews, recruiter responses, board appointments, compensation, promotion or any other career outcome.

Career outcomes depend on factors outside our control.

16.Limitation of liability

Nothing in these Terms excludes liability that cannot lawfully be excluded.

To the extent permitted by law, our aggregate liability arising directly from an Executive Solutions engagement will not exceed the amount paid for the service giving rise to the claim.

We are not responsible for losses caused by false or incomplete information supplied by the client or unauthorised changes made after delivery.

17.Applicable law

These Terms are governed by South African law.

Mandatory consumer rights remain unaffected.
