The terms we work on

1.About us and these terms

These terms form the agreement between you and New Elite Holdings (Pty) Ltd, trading as Elite Executive Career Solutions (“we”, “us”, “our”), whenever you buy a service from us through elite-cv.com or otherwise. By placing an order you confirm that you have read and accept them, together with our Privacy Policy.

Nothing in these terms takes away any right you have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other law that cannot be excluded by agreement. Where a term would do so, it does not apply to you to that extent.

2.Who can buy from us

You must be 18 or older to place an order. If you are under 18, a parent or guardian must place the order on your behalf and accept these terms. If you are ordering for an organisation, you confirm that you have authority to bind it.

3.How ordering works

The description, price and turnaround of each service are shown on its page. Before you pay, the checkout shows you a summary of your order so you can review it, correct any mistakes, or leave without buying. Your order is accepted, and our agreement begins, when your payment is received and we send you an order confirmation by email.

Keep your confirmation email: it is your record of the transaction. If you create an account, your order history is also available under My Account. You can ask us for a copy of your records at any time.

4.Prices and payment

Executive Solutions and Smart CV prices are shown in US dollars. The price shown at checkout is the full amount you pay us. Your bank or payment provider may charge its own currency conversion or transaction fees, which are outside our control.

Payment is due in full when you order. We accept card, PayPal, PayFast and instant EFT, and can invoice for payment by EFT on request. The terms are the same whichever method you use. Work begins once payment has been received.

The price you pay is the price shown when you order. We may change prices for future orders, including when current launch pricing ends, but a change never affects an order you have already placed.

5.How we deliver Executive Solutions

• Intake first. After you order, we send you a secure intake questionnaire to complete in your own time. It replaces a scheduled consultation. A telephone consultation with a dedicated consultant is available on request.
• Turnaround. The turnaround for each service is stated on its page and in your order confirmation. It is counted in business days from the day we receive your completed intake questionnaire, not from the day you order. Business days are Monday to Friday, excluding South African public holidays.
• Expedited delivery. For document services, a 48-hour first draft is available as a paid add-on, subject to availability. If we cannot take your order in that time, you will not be charged for it.
• Who you deal with. A consultant handles all contact with you. Writers are not client-facing.
• Formats. Documents are delivered in Word and PDF. Portfolios are delivered in PowerPoint and PDF.
• Design. You choose your document design and colour in the intake questionnaire. If you ask us to, we choose for you.
• LinkedIn. We deliver your LinkedIn content as a document for you to paste into your profile yourself. We never ask for your password, never log in to your account and never make changes to it.
• Interview preparation is delivered as a personalised written brief built around your target role.

If something outside our control delays your order, we will tell you as soon as we know and agree a revised date with you.

6.Your responsibilities

• Accuracy. You are responsible for making sure that everything you give us is true, accurate and complete, and for checking the finished documents before you use them. We will not include anything in your documents that we know or reasonably believe to be untrue, including qualifications, titles, dates or results.
• Your right to share it. You confirm that you are entitled to give us the information you provide, including anything about other people or about your employer.
• Timely input. Turnaround depends on your completed intake and your feedback on drafts. Delays in either move the delivery date accordingly.
• Use of the finished work. You decide where and how to use your documents, and you are responsible for that use.

7.Revisions

Revisions are free for 30 days from first delivery of your documents. After that, updates to existing information, such as new contact details or minor edits that need no new writing, remain free. Edits that need new content to be written carry a small fee, which we always quote before any work begins.

Revisions refine the documents we have written within the scope of what you bought. A change of target role, market or seniority after delivery is a new brief, and we will tell you in advance if it needs a new order.

8.Cancellation and refunds

Your cooling-off right

If you are an individual buying for yourself, you may cancel your order without reason or penalty within seven days of placing it, and we will refund you in full within 30 days. This right does not apply once we have begun work with your consent before the seven days end. For Executive Solutions, work begins when you submit your intake questionnaire, and at checkout you are asked to confirm that you want us to begin as soon as you do. For Smart CV, see Smart CV below.

Once work has begun

Bespoke work is prepared for you alone and cannot be resold, so once work has begun our refund position is as follows:

• If we cannot deliver and the fault is entirely ours, you receive a full refund.
• If you are not satisfied with the work, we put it right through revisions rather than a refund. That is what the revision period is for, and we would rather get it right than part ways.
• If an engagement cannot proceed for reasons on your side, no refund is due, because the time reserved for your work cannot be recovered.
• In any other situation, we consider a partial refund case by case, after looking into what happened.

Nothing in this section affects your right under the Consumer Protection Act to services performed in a timely manner and to the quality you are entitled to expect, or the remedy of having a defect corrected or a reasonable portion of the price refunded.

9.Smart CV

• What you buy. Smart CV is a self-service platform. You enter your own information and the platform produces your document. Prices are one-time payments with no subscription.
• Immediate supply. Your document is generated as soon as you complete it. At checkout you are asked to confirm that you want it supplied immediately, and once your document has been generated successfully, the seven-day cooling-off right no longer applies.
• Refunds. If the platform fails to produce your document and we cannot fix the problem within a reasonable time, you receive a full refund. Once a document has been generated successfully, no refund is due.
• Your content. The platform works from what you enter, and you are responsible for its accuracy.
• The ATS scan. The free ATS scan gives an indication of how an applicant tracking system may read your document. Employers use many different systems, configured in different ways, so the result is guidance rather than a prediction of how any particular system will treat your application.

10.Corporate Solutions

Corporate engagements are scoped and quoted individually, in South African rand. Your signed proposal governs the engagement, and these terms apply wherever the proposal is silent.

Website projects

Unless your proposal says otherwise:

• proposals are valid for 30 days from issue, and prices exclude VAT
• a 50% deposit is required to begin, with the balance due on your final approval before the site goes live
• invoices are payable within seven business days, and work pauses on invoices outstanding for more than 14 days
• each website includes two rounds of revisions, and further revisions are quoted before any work begins
• ownership of the website’s design and code passes to you on payment in full, while premium plugins and themes are licensed to you under their providers’ own terms
• third-party costs such as domain registration, platform subscriptions and payment transaction fees are yours, and are never marked up

Where an organisation engages us to support its people, we handle each person’s information in line with our Privacy Policy.

11.Confidentiality

Everything you share with us is treated as confidential. We never disclose your identity or your documents, and we never display client work. Where we refer to a client publicly, it is by role, sector and country only. A non-disclosure agreement is available on request and can be signed before you share anything.

12.Ownership of the work

Once you have paid in full, your finished documents are yours. You may use, edit, copy and share them as you wish for your own career or, for corporate clients, for your organisation’s own purposes.

Our design templates, layouts, methodology, including the Executive Career Positioning Suite™, and the content of this website remain ours. Receiving documents designed with our templates does not give you the right to reuse the templates themselves to produce documents for anyone else, or to sell or distribute them. The same applies to the Smart CV platform: the documents you create are yours, and the platform, its templates and its software remain ours.

13.No promise of outcomes

We position you as strongly as your record allows, but hiring and appointment decisions are made by other people. We do not promise, and cannot promise, that any document or service will result in an interview, an offer, an appointment, a board seat, a contract award or a particular salary. Clients sometimes tell us what happened next, in their own words. That is their account, not a promise of ours.

14.Limits on our liability

To the extent the law allows, our total liability to you for any claim arising from a service is limited to the amount you paid for that service. We are not liable for indirect or consequential loss, such as loss of an opportunity, income or profit, that arises from your use of our documents or services.

These limits do not apply to loss caused by our gross negligence or wilful misconduct, and they do not limit any right you have that the law does not allow us to exclude.

15.Third-party platforms

Your documents may be used on platforms we do not control, such as LinkedIn, job boards, recruiters’ systems and procurement portals. Those platforms have their own rules and may change how they work at any time. We are not responsible for how a third-party platform treats your documents or your account.

16.Complaints and disputes

If something has gone wrong, please tell us first. Write to [email protected] with the subject line “Complaint” and your order number. We reply within one business day and will work with you to put it right.

If we cannot resolve it between us and you are a consumer, you may refer the matter to the Consumer Goods and Services Ombud, or to the National Consumer Commission. You may also approach a court with jurisdiction.

17.Law and jurisdiction

These terms are governed by the law of the Republic of South Africa. If you are a consumer living outside South Africa, you keep any protection that the law of your own country gives you and that cannot be excluded by agreement.

18.Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they last changed. The terms that apply to your order are the ones published when you placed it.
